Pursuant to articles 13 and 14 of the General Data Protection Regulation 2016/679 (“GDPR”), please be informed that Lingaro may be collecting and processing some of your personal data, subject to the detailed information presented below. 

I. Personal data controller:

III. Categories of data we collect and process

We may process personal data including name, surname, email address, company affiliation, address, IP address, and other information you provide depending on your relationship to us as a partner, client, supplier, website user, or if you are seeking cooperation or employment with Lingaro. Further details regarding data processing in the recruitment process are outlined in a separate “Information clause” available when you submit an application.

Please be informed that we use LinkedIn Sales Navigator Platform, and the feature of Smart Links. This feature allows us to package and share various types of content, e.g. slide decks, videos or website URLs, with our clients, prospects and other third parties, using a single trackable link. Smart Links allows to track viewing behavior and gain insights on what they are most interested in. Once you click on the Smart Link we will collect and process the following data:

  • Confirmation that you clicked the link to the Smart Links content, and the number of times you clicked the link;
  • The amount of time you spent on the Smart Links content;
  • The date and time that the Smart Links content was accessed by you;
  • If signed in to LinkedIn, basic information from your LinkedIn profile such as name, title, company, and public profile picture;
  • If not signed into LinkedIn, the name you provided prior to accessing the Smart Links content, and optionally your email address, if you chose to provide it.

IV. Purpose and legal basis of personal data processing

We process your personal data for the following purposes and using the following legal justifications:

  1. Conclude and perform the contract for Lingaro services - since such processing is essential to perform the contract (Article 6 sec. 1(b) GDPR)

  2. Direct marketing of products or services - since such processing is essential to serve our legitimate interest (Article 6 sec. 1(f) GDPR), i.e. a possibility of implementing direct marketing strategies; where required by law, e.g. with respect to direct marketing carried out through electronic means of communication or phone, we will seek your prior consent 

  3. Lodge, seek and defend against claims related to the conclusion of a contract or processing of your personal data - since such processing is essential to serve our legitimate interest (Article 6 sec. 1(f) GDPR), i.e. our possibility of lodging, seeking or defending against claims

  4. Fulfill legal obligations under applicable law - since such processing is essential to meet binding legal requirements (Article 6 sec.1(c) GDPR)

  5. Respond to your questions sent via contact form or via email – as this is our legitimate interest (Article 6 sec. 1(f) GDPR) i.e. keeping in touch with you, responding to your queries and ensuring good customer service;

  6. Establish communication and maintain business relationships— since the processing is necessary for the legitimate interests of Lingaro, i.e. conducting business activity and providing services (Article 6(1)(f) of the GDPR);

  7. Organization and execution of events (conferences, presentations, webinars), including the sending of materials related to the event (e.g., recordings, presentations) based on your consent (Article 6(1)(a) GDPR).


V. Categories of data recipients
Your personal data may be shared with or made available to the following categories of entities:

  1. Companies affiliated with Lingaro (belonging to Lingaro Group);
  2. Entities authorized under applicable law (such as courts, state authorities, etc.)
  3. Entities rendering for us various services that are related to processing activities mentioned above, such as accounting, IT, marketing, communication and analytical, legal and debt collection services;
  4. Our subcontractors and other entities, with which we collaborate.
     
VI. Transfer of data outside the European Economic Area (EEA)

Since Lingaro is a part of a wider group of companies, we may transfer your personal data to, or otherwise allow access to such data by other entities within the group, which may use, transfer, and process the data for the following purposes: to maintain and improve lead generation process; to maintain IT systems; to monitor and ensure compliance with applicable laws, policies and procedures; to establish and defend our legal rights; and to respond to requests and legal demands from regulators and other authorities. Our Group comprises companies located in both EEA and non-EEA countries, including Poland, Switzerland, India, Philippines, Singapore, USA, UK and Mexico. We only transfer your personal data to non-EEA countries if either the EU Commission has decided that the country has an adequate level of data protection or we provide appropriate safeguards. We generally provide those safeguards by entering into appropriate data transfer agreements based on Standard Contractual Clauses (pursuant to Article 46(2)(c) GDPR). Where required by laws, you may request a copy of the appropriate safeguards we have in place by contacting our Data Protection Officer (Section II. The Data Protection Officer).  

VII. Period of data retention
We’ll process your personal data not longer than it is necessary i.e. only as long as we need them e.g. in order to provide our services to you or for other legitimate business purposes. The retention period might depend on the purpose for processing the data, the amount, nature, and sensitivity of the data and the legal requirements applicable to us.

In particular, following general rules for determining data retention periods will apply:

  1. With regard to personal data which we process in order to perform the contract - until the limitation period of claims that may result from a given contract between us and you or legal entity you represent (as a rule, this period will not exceed 7 years from the termination or expiration of such contract)

  2. With regard to personal data which we process for the purposes of marketing of products and services - by the time of termination or expiry of the contract or filing of an objection or with respect to direct marketing carried out through electronic means of communication or phone, once you withdraw your consent to receive such communication;

  3. With regard to personal data which we process in order to fulfill legal obligations - by the time of expiry of the obligation to store personal data under applicable law

  4. With regard to personal data which we process in order to lodge, seek or defend against claims - until the limitation period of such claims or until such claims are finally settled

  5. With regard to personal data which we process in order to provide answers to questions asked via contact form - for the time necessary to execute the contact and provide you with all information you required or until you successfully object such processing

VIII. Your rights

Pursuant to the GDPR, you are entitled to:

  1. Access your personal data and obtain the copies thereof
  2. Rectify (correct, supplement) your personal data
  3. Remove or restrict the processing of your personal data
  4. Where applicable (Section IV. Point 7) withdraw your consent to process your personal data at any time. The withdrawal of your consent shall not affect compliance with the right to process exercised on the basis of such consent prior to its withdrawal.
  5. Transfer your personal data to another controller

You can also file a complaint with the supervisory body, if you believe that Lingaro is processing your personal data in violation of the law. You may, at any time, object against the processing of your personal data: by contacting our Data Protection Officer as indicated in Section II Data Protection Officer above. 

 
X. Information on the requirement or voluntary character of providing personal data and the consequences of failing to provide personal data.

The provision of your personal data is voluntary, but essential to conclude and perform contracts, including the use of Lingaro services.


XI. Automated decision making and profiling

Your personal data will not be subject to automated decision-making, however, certain marketing activities pertaining to our own services may be preceded by profiling, understood as an automated matching of our shared content to your interests or needs that we have identified. Such processing or personal data is necessary for purposes arising from our legitimate interests (Article 6(1)(f) of the GDPR), as described in Section IV above. 

We will not proceed with profiling that is capable of producing legal effects for you or significantly affecting you in other similar ways, if we do not receive your consent for such processing beforehand (Article 6(1)(a) of the GDPR).
